Terms of Service

Effective 2026-05-29 · Last updated 2026-05-29

By using GhostDesk you connect your own storage and remain responsible for your bucket, credentials, and shared links.

These terms govern GhostDesk Phase 1. They are a pre-launch draft for founder review — not legal advice.

1. Agreement

These Terms of Service ("Terms") govern your use of the GhostDesk desktop application, related websites, and share-link guest pages (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. The service

GhostDesk provides a user interface and tooling to connect to S3-compatible object storage you control. GhostDesk is not a storage provider and does not sell storage capacity.

Features may change between versions. Phase 1 includes browse, upload, download, share links, Ghost Mode lock, and single-bucket workspaces unless we announce otherwise.

3. Your storage and data

You are solely responsible for:

  • Choosing and paying your S3-compatible provider.
  • Creating and securing access keys with appropriate permissions.
  • Contents stored in your bucket, including compliance with applicable laws.
  • Backups, retention, and recovery of your data.
  • Costs charged by your storage provider (egress, storage, API operations).

4. Account and security

You must provide accurate account information and keep your login credentials confidential.

Your encryption password protects your stored S3 credentials. If you lose it, we cannot recover your encrypted storage configuration.

You must notify us promptly of unauthorized access to your account.

5. Acceptable use

You agree not to use the Service to:

  • Violate any law or third-party rights.
  • Upload or distribute malware, illegal content, or content you lack rights to share.
  • Attempt to bypass security, probe systems without authorization, or interfere with other users.
  • Resell or misrepresent the Service as your own storage hosting.

7. Software and updates

We may release updates through app stores or automatic update channels. Continued use after updates constitutes acceptance of changes where permitted by store policies.

The cryptographic module may be published separately under an open-source license for audit transparency.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free operation, or that the Service will meet your requirements.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTDESK AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE OR YOUR STORAGE PROVIDER.

Our aggregate liability for direct damages is limited to the amount you paid us for the Service in the twelve (12) months before the claim (or USD $100 if the Service was free).

10. Indemnification

You agree to indemnify and hold harmless GhostDesk from claims arising out of your bucket contents, shared links, violation of these Terms, or misuse of the Service.

11. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate access for breach of these Terms, legal requirements, or abuse. Termination does not delete objects in your bucket — you retain control via your provider.

12. Governing law

These Terms will be governed by the laws of the jurisdiction where GhostDesk is incorporated, without regard to conflict-of-law principles. Specific jurisdiction to be finalized before store submission.

13. Changes

We may modify these Terms. We will post updates at this URL with a revised "Last updated" date. Continued use after changes constitutes acceptance where allowed by law.
